API Now – Closed Beta Terms and Conditions

Welcome to API Now! These Terms and Conditions ("Terms") govern your access to and use of the API Now platform, website, and associated services (collectively, the "Service").

PLEASE READ CAREFULLY: The Service is currently in a "Closed Beta" phase. By accessing or using the Service, you acknowledge and agree that the platform is still in development, is not intended for production environments, and is provided strictly under the terms outlined below.

1. Closed Beta Status and Permitted Use

  • Development Environment Only: During the Closed Beta, the Service is provided strictly as a development, testing, and evaluation environment.
  • Production Workloads Prohibited: You are strictly prohibited from using the Service for live, commercial, or production workloads. If you require a dedicated runtime, enhanced resilience, or production-level deployment, you must contact us directly at beta@apinow.app to discuss authorization.
  • Beta Limitations: The Service may contain bugs, errors, or inaccuracies that could cause failures, corruption, or loss of data. You use the Service entirely at your own risk.

2. Fees, Data Limits, and Quotas

  • Free Access: Participation in the Closed Beta is currently free of charge.
  • Strict Data Limit: Your account is strictly limited to 500MB of data storage.
  • Limit Increases: You may request a data limit increase by contacting our support team. All requests are evaluated on a case-by-case basis. We reserve the absolute right to refuse any request for a limit increase for any reason, at our sole discretion.

3. Acceptable Use Policy (AUP)

To protect the integrity of our infrastructure, you agree NOT to use the Service to:

  • Host Prohibited Content: Store, process, or serve illegal content, malware, phishing sites, or highly regulated data (including, but not limited to, HIPAA-regulated Protected Health Information or PCI-regulated financial data).
  • Abuse Resources: Attempt to bypass rate limits, overwhelm our serverless runtime, or utilize the platform for resource-intensive operations such as cryptocurrency mining or large-scale data scraping.
  • Reverse Engineer: Decompile, disassemble, or reverse-engineer the Service, including our proprietary "Tags-to-Policies" semantic engine, visual modeler, or runtime architecture.

4. Intellectual Property and Data Ownership

  • API Now Property: API Now retains all rights, title, and interest in and to the Service, including the visual modeler, the semantic engine, the AI Copilot prompts, the runtime architecture, and all underlying software and intellectual property.
  • Your Property: You retain all ownership rights to your specific Data Domains, the data you store within the provisioned PostgreSQL databases, and the API definitions you generate.
  • License to Host: By using the Service, you grant API Now a worldwide, royalty-free license to host, process, compute, and transmit your data solely for the purpose of providing the Service to you.

5. AI and Generative Content Disclaimers

  • AI Copilot Suggestions: The Service utilizes an AI Copilot and external Large Language Models (LLMs) to generate data models, schemas, and API definitions. These generated outputs are suggestions only. You, as the API Author, are solely responsible for reviewing, testing, and approving all generated logic and schemas before deployment.
  • Third-Party AI Providers: Our AI features rely on third-party providers. You agree not to use the AI generation features in a manner that violates the terms of service of those underlying providers.

6. Termination and Program Sunset

  • Beta Program Sunset: API Now reserves the right to modify, suspend, or completely shut down the Closed Beta program at any time. In the event we decide to sunset the Closed Beta program, we will provide you with a 1-month (30 days) written notice to the email address associated with your account. During this 30-day period, you will be provided with a mechanism to download and export your data.
  • Termination for Cause: Notwithstanding the above, API Now reserves the right to immediately suspend or terminate your account and access to the Service, without prior notice, if we determine that you have violated these Terms, particularly the Acceptable Use Policy (Section 3).

7. Disclaimer of Warranties and Limitation of Liability

  • "AS-IS" Delivery: THE SERVICE IS PROVIDED ON AN "AS IS" AND "AS AVAILABLE" BASIS. API NOW EXPLICITLY DISCLAIMS ALL WARRANTIES, EXPRESS OR IMPLIED, INCLUDING BUT NOT LIMITED TO IMPLIED WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, AND NON-INFRINGEMENT. WE DO NOT GUARANTEE UPTIME, RELIABILITY, OR BUG-FREE OPERATION.
  • Limitation of Liability: IN NO EVENT SHALL API NOW, ITS FOUNDERS, OR AFFILIATES BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES, OR ANY LOSS OF PROFITS, REVENUE, DATA, OR DATA USE ARISING OUT OF OR IN CONNECTION WITH YOUR USE OF THE CLOSED BETA SERVICE, EVEN IF ADVISED OF THE POSSIBILITY OF SUCH DAMAGES.

8. General Provisions

  • Modifications: We may modify these Terms at any time. We will notify you of any material changes via email or through the Service platform.
